Please read these terms carefully before using our services

Welcome to Aura Pool Sky. These Terms of Service ("Terms") govern your access to and use of our rooftop pool facility, services, and amenities located at Palm Tower, Level 49, Dubai, UAE. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By making a reservation, purchasing a ticket, or entering our premises, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Eligibility and Age Requirements

Our services are available to individuals who meet the following criteria:

  • You must be at least 21 years of age to access our rooftop pool facility independently
  • Guests between 18-20 years of age may access the facility when accompanied by a parent or legal guardian
  • Children under 18 must be accompanied by an adult at all times
  • You must possess valid identification that can be presented upon request
  • You must be physically capable of using pool facilities safely

3. Reservations and Bookings

3.1 Booking Process

Reservations can be made through our website, mobile application, or by contacting our reservations team at +971 50 284 9573 or support@aurapoolsky.ae. All bookings are subject to availability and confirmation.

3.2 Payment Terms

Full payment is required at the time of booking unless otherwise specified. We accept major credit cards, debit cards, and other payment methods as indicated during the booking process. All prices are listed in UAE Dirhams (AED) and include applicable taxes unless stated otherwise.

3.3 Cancellation Policy

  • Standard Bookings: Cancellations made 48 hours or more before the scheduled visit will receive a full refund
  • Late Cancellations: Cancellations made between 24-48 hours before the visit will receive a 50% refund
  • No-Show: Cancellations made less than 24 hours before the visit or failure to appear will result in forfeiture of the full booking amount
  • Special Events: Private events and special packages may have different cancellation terms, which will be communicated at the time of booking

3.4 Modifications

Requests to modify your reservation must be made at least 24 hours in advance and are subject to availability. We will make reasonable efforts to accommodate your requested changes, but cannot guarantee availability for alternative dates or times.

4. Facility Access and Usage

4.1 Operating Hours

Our facility operates according to posted hours, which may vary by season and special events. We reserve the right to modify operating hours with reasonable notice. Current operating hours are available on our website and can be confirmed by contacting our team.

4.2 Capacity Limitations

To ensure a premium experience for all guests, we maintain strict capacity limits. Entry may be restricted when capacity is reached, even for guests with reservations made during peak periods. We recommend arriving during your designated time slot to ensure entry.

4.3 Dress Code

Appropriate swimwear is required for pool access. We maintain a sophisticated atmosphere and reserve the right to refuse entry to guests whose attire does not meet our standards. Cover-ups, footwear, and appropriate casual attire are required in non-pool areas.

Important: For safety and hygiene reasons, street clothes, denim, and inappropriate swimwear are not permitted in pool areas. Proper swimming attire must be worn at all times while in the water.

5. Conduct and Behavior Standards

5.1 Guest Conduct

All guests are expected to conduct themselves in a respectful and appropriate manner. The following behaviors are strictly prohibited:

  • Disruptive, aggressive, or threatening behavior toward staff or other guests
  • Excessive noise or disturbances that interfere with other guests' enjoyment
  • Running, diving, or engaging in unsafe behavior in pool areas
  • Consumption of outside food or beverages (except for medical or infant care purposes)
  • Smoking or vaping in non-designated areas
  • Photography or videography of other guests without their explicit consent
  • Any illegal activities or possession of prohibited substances

5.2 Alcohol Service

Alcoholic beverages are served in accordance with UAE laws and regulations. We reserve the right to refuse service to any guest who appears intoxicated or is unable to provide valid identification proving they are of legal drinking age. Guests who become intoxicated may be asked to leave the premises without refund.

5.3 Right to Refuse Service

We reserve the right to refuse service, terminate access, or remove any guest from the premises who violates these Terms, engages in inappropriate behavior, or poses a safety risk to themselves or others. No refunds will be provided in such cases.

6. Safety and Health

6.1 Swimming Proficiency

Guests must be able to swim competently to use our infinity pool facilities. While lifeguards are present during operating hours, guests use the pool at their own risk. Parents and guardians are responsible for supervising children at all times.

6.2 Health Conditions

Guests with medical conditions, including but not limited to heart conditions, respiratory issues, or pregnancy, should consult with their physician before using our facilities. Please inform our staff of any medical conditions that may require special attention or accommodation.

6.3 Hygiene Requirements

For the health and safety of all guests, we require:

  • Showering before entering pool areas
  • Refraining from using the pool if you have open wounds, infections, or communicable diseases
  • Using designated restroom facilities
  • Following all posted hygiene and safety guidelines

7. Personal Property and Liability

7.1 Personal Belongings

While we provide secure locker facilities, Aura Pool Sky is not responsible for lost, stolen, or damaged personal property. We strongly recommend using provided lockers and not bringing valuable items to the facility. Any items left behind will be held in our lost and found for 30 days before being donated or disposed of.

7.2 Limitation of Liability

To the fullest extent permitted by law, Aura Pool Sky, its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Use of our facilities, services, or amenities
  • Accidents, injuries, or health issues occurring on our premises
  • Loss or damage to personal property
  • Interruption or cancellation of services due to weather, maintenance, or unforeseen circumstances
  • Any other cause beyond our reasonable control

7.3 Assumption of Risk

By using our facilities, you acknowledge and assume all risks associated with swimming, pool activities, and use of our amenities. You agree to release and hold harmless Aura Pool Sky from any claims arising from your use of our services, except in cases of gross negligence or willful misconduct on our part.

8. Photography and Media

8.1 Facility Photography

We may take photographs and videos on our premises for marketing, promotional, and operational purposes. By entering our facility, you consent to being photographed or recorded and grant us the right to use such images in our marketing materials without compensation.

8.2 Guest Photography

Personal photography for private use is permitted. However, commercial photography, professional equipment, drones, and photography of other guests without their consent are strictly prohibited without prior written permission from management.

9. Intellectual Property

All content on our website, mobile applications, and marketing materials, including but not limited to text, graphics, logos, images, and software, is the property of Aura Pool Sky or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy, available at privacy_policy.html.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather conditions, or acts of God
  • Government actions, regulations, or restrictions
  • Public health emergencies or pandemics
  • Terrorism, war, or civil unrest
  • Utility failures, equipment malfunctions, or infrastructure issues
  • Labor disputes or strikes

In such events, we will make reasonable efforts to notify affected guests and provide alternative arrangements or refunds where appropriate.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any changes.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from or relating to these Terms or your use of our services shall be resolved through the following process:

  • Informal Resolution: We encourage you to contact us first to attempt to resolve any disputes informally
  • Mediation: If informal resolution is unsuccessful, disputes shall be submitted to mediation in Dubai
  • Arbitration: If mediation fails, disputes shall be finally resolved by arbitration under the rules of the Dubai International Arbitration Centre (DIAC)
  • Jurisdiction: The courts of Dubai shall have exclusive jurisdiction over any matters not resolved through arbitration

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms provided at the time of booking, constitute the entire agreement between you and Aura Pool Sky regarding your use of our services and supersede all prior agreements, understandings, and communications.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Aura Pool Sky.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
